TERMS OF USE

My RTC Connect is provided by Reservation Telephone Cooperative d/b/a RTC Networks (“My RTC Connect”) permits customers (“you”) to access voice, text and/or data services on a pre-paid basis (the “Services”). Services are available only within supported coverage area and are subject to network availability, technical limitations, and applicable laws and regulations. These Terms explain your rights and responsibilities when you use the Services. If you use the Services, you agree to these Terms.

By using the Services, you represent and warrant that you (1) READ, UNDERSTAND AND ACCEPT THESE TERMS WITHOUT LIMITATION OR QUALIFICATION; and (2) ARE AT LEAST 18 YEARS OLD AND CAN FORM LEGALLY BINDING CONTRACTS.

If you do not agree to be bound by all of these Terms, you may not access or use the Services. We reserve the right to modify these Terms in our discretion at any time. Such modifications will be effective upon posting. Any use of the Services after any modifications are posted constitutes acceptance of such modifications. My RTC Connect makes no representation that the Services are suitable or available for use.

To obtain the Services, you must activate and maintain a My RTC Connect account.

Dispute Resolution & Class Action Waiver

These terms shall be governed by and enforced in accordance with the laws of the State of North Dakota without regard to its conflicts of law rules.

BY USING THE SERVICES, YOU AGREE THAT YOU WILL NOT FILE A CLASS ACTION AGAINST MY RTC CONNECT OR PARTICIPATE IN A CLASS ACTION AGAINST MY RTC CONNECT. YOU FURTHER AGREE THAT YOU WILL NOT FILE OR SEEK A CLASS ARBITRATION, OR PARTICIPATE IN A CLASS ARBITRATION, AGAINST RTC CONNECT.

Security

You understand that the Services is not inherently secure and that communication transmitted through or using the Services may not remain private or free of interception or access by others. YOU AGREE THAT MY RTC CONNECT, ITS PARENT AND AFFILIAITES WILL NOT BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY BREACH OF SECURITY THAT MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION ANY INTERCEPTION OF TRANSMISSIONS, LOSS OF DATA, FILE CORRUPTION, HACKING OR DAMAGE TO YOUR NETWORK, COMPUTER OR OTHER DEVICE THAT RESULTS FROM THE TRANSMISSION OR DOWNLOAD OF INFORMATION, MATERIALS OR CONTENT THROUGH THE SERVICES. You further agree that you are solely responsible for implementing and maintaining appropriate technological and other safeguards to ensure the safety and security of your network, computer, or other device and anything stored on, or transmitted by, your network, computer, or other device.

Restrictions

By using the Services you agree that you will not:

  • Use any device, software, or other method to interfere with the proper working of the Services;
  • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
  • Attempt to bypass or circumvent any measures that limit access to the Services;
  • Use the Services in any threatening, libelous, slanderous, defamatory, obscene, inflammatory, pornographic, discriminatory, or otherwise offensive manner;
  • Use the Services to send unsolicited bulk and/or commercial messages over the Internet;
  • Use the Services to engage in activity that infringes or misappropriates the intellectual property rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third party;
  • Use the Services to distribute Internet viruses, Trojan horses, or other destructive activities;
  • Transfer technology, software, or other materials in violation of law, including export laws and regulations;
  • Sell, transfer or rent the Services to customers, clients or other third parties; or
  • Use the Services for any purpose that is illegal, unlawful, or prohibited by these Terms.

The My RTC Connect account holder is responsible for the conduct of anyone who uses the Services. We reserve the right in our sole discretion to suspend or revoke your access to the Services for any reason, including if you violate these Terms.

My RTC Connect will cooperate with appropriate law enforcement agencies and other parties involved investigating claims of alleged illegal, abuse, or improper activity. We reserve the right to use and disclose records relating to the use of the Services to the extent authorized by applicable laws and regulations, in response to lawful process, orders, subpoenas, or warrants, or to protect any other person from harm.

Notice and Procedure for Making Copyright Infringement Claims

My RTC Connect respects the intellectual property of others. We will respond to notices of alleged copyright infringement in accordance with the requirements of the United States Digital Millennium Copyright Act. If you believe that anything on the Services infringes your copyright, you may file a notification of such infringement by Contacting RTC Networks (ADD CONTACT INFORMATION)

If you knowingly misrepresent that material or activity is infringing, you may be liable for any damages including costs and attorneys’ fees, incurred by us or the alleged infringer as a result of our reliance on your misrepresentation.

Disclaimer of Warranties

You understand and agree that:

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES AND ALL CONTENT AND INFORMATION (INDLUCING, WITHOUT LIMITATION, ANY INFORMATION OR CONTENT OBTAINED OR ACCESSED THROUGH THE SERVICES) ARE PROVIDED ON AN “AS IS,” “WHERE IS,” “AS AVAILABLE” AND “WITH ALL FAULTS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MY RTC CONNECT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSES, NONINFRINGEMENT OF PROPRIETARY RIGHTS, AND SYSTEM INTEGRATION QUALITY.

MY RTC CONNECT DISCLAIMS ANY WARRANTIES OR LIABILITY REGARDING THE SECURITY, RELIABILITY, AVAILABILITY, APPROPRIATENESS, SUITABILITY, TIMELINESS, AND PERFORMANCE OF THE SERVICES. WE MAKE NO WARRANTY THAT (1) THE SERVICES WILL MEET YOUR REQUIREMENTS; OR (2) THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

THERE IS NO WARRANTY OR GUARANTEE REGARDING THE AVAILABILITY, COVERAGE, SPEED OR QUALITY OF THE SERVICES. MY RTC CONNECT DISCLAIMS ANY WARRANTY OR LIABILITY FOR ANY VIRUSES OR OTHER HARMFUL APPLICATIONS THAT MAY TRAVEL THROUGH THE SERVICES. WE DO NOT WARRANT OR GUARANTEE THE SECURITY OF THE SERVICES. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR ACTIVITIES CONDUCTED ONLINE THROUGH THE SERVICES AND ASSUME ALL LIABILITY AND DAMAGES INCURRED, WHETHER KNOWN OR UNKNOWN AT THE TIME OF USE.

Indemnity

You agree to indemnify and  hold harmless, Reservation Telephone Cooperative, the location owner and/or operator, and their respective subsidiaries, affiliates, officers, agents, or other partners and employees from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of (1) materials you submit, post, transmit or otherwise make available through the Services; (2) your use of the Services; (3) your violation of these Terms; (4) your violation of any rights of another, and (5) use of your account whether such usage is expressly authorized by you.
